Judges site nonsense poem in ordering release of Guantanamo detainee

WASHINGTON — A U.S. court has compared a military decision to detain a Chinese Muslim as an enemy combatant to a nonsensical 19th-century poem by Lewis Carroll.

The U.S. Court of Appeals for the District of Columbia Circuit chided the government for its logic Monday in what is the first court ruling analyzing a decision to hold a detainee at the prison camp in Guantanamo Bay, Cuba.

The government insisted that a piece of evidence used to hold the detainee for years was valid because it appeared on three documents.

But the appeals court said all three documents apparently came from the same dubious source.

The judges compared the government argument to "The Hunting of the Snark," an 1876 poem that includes the line, "I have said it thrice: What I tell you three times is true."

The court ordered the detainee to be set free.
